Daejeon City Wins Appeal in Wolpyeong Park Private Special Case Project

[Asia Economy (Daejeon) Reporter Jeong Il-woong] Daejeon City won the appeal trial against the proposer of the Wolpyeong Park (Galma District) special project. This overturned the first trial ruling that had favored the business side.


According to the city on the 28th, the Administrative Division 1 of the Daejeon High Court (Chief Judge Shin Dong-heon) overturned the original ruling and ruled against the plaintiff in the lawsuit filed by Daejeon Wolpyeong Park PFV Co., Ltd. against the city, seeking cancellation of the withdrawal of acceptance of the urban park private special project proposal.


The urban park private special project was promoted with the main goal of constructing apartment complexes with 2,739 households on 172,438㎡ (12.4%) of the total 1,391,599㎡ site in the Wolpyeong Park Galma District, and creating a park on the remaining 219,161㎡ (87.6%) of the site.


However, the project (proposed by the business side) was withdrawn after the Urban Planning Committee discovered that the business side had submitted false documents.


In this regard, the first trial (Daejeon District Court) ruled in favor of the company. The essence of the ruling was that if there was a problem with the business side’s proposal, they should have been given an opportunity to supplement it.


On the other hand, the Daejeon High Court, which handled the appeal, had a different judgment. The court cited the lack of firm trust in the business side and the circumstances before and after the cancellation of acceptance of the proposal, emphasizing the great necessity of the withdrawal of acceptance.


In particular, the court emphasized that the public interest gained by preserving the park through the cancellation of the project proposal outweighs the private interest gained by protecting the business side’s damages.


Regarding this ruling, Jeon Jae-hyun, Director of the Environmental Greenery Bureau of the city, said, “The Daejeon High Court’s ruling centers on the fact that the public interest in preserving the Wolpyeong Park Galma District as it originally was is greater than the private interest.” He added, “Based on this, the city plans to develop the Wolpyeong Park Galma District into a forest-type park with enhanced green space preservation and urban forest functions.”


Meanwhile, this lawsuit began when Wolpyeong Park PFV raised objections in July 2019 against the city’s cancellation of the acceptance decision for the Wolpyeong Park special project.
