Ministry of Justice Orders CJ CGV, iMBC, and Others to Correct Disability Discrimination

[Asia Economy Reporter Kim Hyung-min] The Ministry of Justice announced on the 7th that it has issued corrective orders for acts of discrimination against persons with disabilities to CJ CGV, iMBC, SBS Contents Hub, and others.


Based on the deliberation results of the Disability Discrimination Correction Deliberation Committee, the Ministry of Justice issued corrective orders for a total of four cases of discrimination against persons with disabilities.


First, the Ministry ordered the presidents of broadcasting companies operating and managing iMBC, SBS Contents Hub, and Busan MBC to improve their websites to ensure accessibility for persons with disabilities.


Additionally, the CEO of CJ CGV Co., Ltd., which operates movie theaters, was ordered to provide measures such as text interpretation support to allow participation in content programs upon request from hearing-impaired persons who cannot hear even when using hearing aids.


An order was also issued to prepare accessible seating for persons with disabilities using wheelchairs in the CGV Yeouido Comfort Hall and Premium Hall.


The CEO of Wolmi Theme Park was ordered to stop uniformly refusing ride access on safety grounds without considering the individual disability level of persons with disabilities, or requiring accompaniment by a non-disabled guardian.


According to Article 43 of the Act on the Prohibition of Discrimination against Persons with Disabilities and Remedy against Infringement of their Rights, the Minister of Justice may issue corrective orders to those who have committed discriminatory acts upon the victim’s application or ex officio. This law grants such authority to the Minister of Justice when a person who has received a recommendation from the National Human Rights Commission for discriminatory acts against persons with disabilities fails to comply without justifiable reasons.


Until now, the corrective order system has been criticized for its ineffectiveness due to few actual cases of use. In response, the government has relaxed the requirements for corrective orders under the Disability Discrimination Act, which has been in effect since June, and improved the Disability Discrimination Correction Deliberation Committee, previously held once a year by the Ministry of Justice, to be held quarterly.


The Deliberation Committee is an organization based on Article 23 of the Enforcement Decree of the Act on the Prohibition of Discrimination against Persons with Disabilities and Remedy against Infringement of their Rights. It reviews whether the recommendations of the National Human Rights Commission regarding discrimination against persons with disabilities have been properly implemented and recommends corrective orders to the Minister of Justice for matters deemed to require additional measures.
