On the 6th, according to the legal community, the Gwangju District Court Criminal Division 9 (Presiding Judge Kim Doo-hee) sentenced surgeon A (41) and unlicensed doctor B (70), who were indicted on charges of fraud and professional negligence causing injury, to 10 months in prison.
They were prosecuted for performing breast (mastopexy with augmentation) surgery on a woman in her 30s at an illegal administrative hospital in Naju, Jeollanam-do, in November 2018, causing injuries including necrosis of both breasts with a recovery period of six weeks.
It was revealed that during the surgery, they did not conduct necessary procedures such as preliminary ultrasound examinations without professional medical knowledge.
The victim received compensation amounting to approximately 40 million KRW, including 9 million KRW for the surgery fee, as damages.
The court ruled, "Mastopexy with augmentation is a highly advanced plastic surgery procedure that requires considerable surgical experience."
It added, "The defendants performed surgery on the victim using incorrect surgical methods, causing serious injuries and demonstrating a severe breach of duty of care. The victim suffered great pain from this incident, which increases the degree of blameworthiness," explaining the reasons for sentencing.
