[Asia Economy Reporter Hwang Sumi] A woman in her 20s who anonymously posted defamatory remarks about her classmates and seniors on a university free bulletin board received a suspended sentence for a fine.
According to the legal community on the 5th, the Gwangju District Court Criminal Division 7 (Presiding Judge Lee Hosan) suspended the sentence of a 1 million won fine for A (23), who was tried for violating the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. (defamation).
A suspended sentence is a ruling that postpones the sentencing for a certain period for minor crimes, and if the defendant remains without any incidents during the suspension period, the case is considered null and void.
According to the judgment, around December last year, A accessed the free bulletin board of a university in Gwangju anonymously and posted writings about B, a middle school classmate, and C, B's older sister and a senior at school.
A claimed in the post that she was subjected to school violence by B and C during middle school. In particular, A emphasized that the sisters forcibly taped her hair, hid her bag, dragged her to the bathroom, lifted her skirt, and made her try sanitary pads.
She wrote, "I even developed panic disorder, but seeing them still living well makes me very angry."
The court stated, "The defendant used the information and communication network with the intent to defame, openly damaging the victims' honor," but "considering circumstances that warrant leniency regarding the motive or background of this case and the fact that this is a first offense, the sentence was determined."
