Notice of Legislative Proposal for Amendment to the Enforcement Decree of the Eco-Friendly Vehicle Act
Existing Chargers Inside Buildings to Be 2% of Parking Spaces
[Asia Economy Reporter Joo Sang-don] Starting next year, existing buildings will also be required to install electric vehicle chargers for 2 out of every 100 parking spaces.
On the 27th, the Ministry of Trade, Industry and Energy announced that it will publicly notify the partial amendment of the Enforcement Decree of the "Act on the Development and Promotion of Environmentally Friendly Automobiles" until October 6th.
The main point of this amendment is to expand the mandatory installation targets for electric vehicle charging facilities to accelerate the spread of chargers centered on residential and living environments. The requirement for apartments will be expanded from buildings with 500 or more households to those with 100 or more households, and for public facilities and public parking lots, from those with 100 or more total parking spaces to those with 50 or more.
Additionally, the number of charging facilities to be installed has been strengthened: newly constructed facilities that received building permits after the enforcement date (January 28, 2022) must have chargers for 5% of total parking spaces (currently 0.5%), and existing facilities that received permits before the enforcement date must have 2% (newly established). For example, an existing apartment with 1,000 parking spaces must install 20 electric vehicle chargers.
However, for existing facilities, installation deadlines for electric vehicle charging facilities are set by facility type such as public facilities, public-use facilities, and apartments to secure preparation time for charger installation. Public facilities are to establish charging facilities within one year after the law’s enforcement as a lead, public-use facilities within two years, and apartments are given a three-year installation deadline to ensure sufficient preparation time.
This amendment also requires that information about charging facilities, such as location, opening hours, and usage conditions, be disclosed on information and communication networks to allow electric vehicle users who have difficulty charging at home or work to easily use nearby public charging facilities. Furthermore, in addition to the national government, local governments, public institutions, and local public enterprises mandated by law to purchase electric and hydrogen vehicles and open their charging facilities, government-funded research institutes and local government-invested or supported institutions are added to the scope of mandatory opening.
An official from the Ministry of Trade, Industry and Energy stated, "We will carefully review opinions raised during the public notification period and diligently prepare for regulatory review. We will also proceed smoothly with the establishment and revision of notifications to set the purchase ratio of eco-friendly vehicles and charging facility standards."
