[Asia Economy Reporter Bae Kyunghwan] Jung Yura, the daughter of Choi Seo-won (formerly Choi Soon-sil), the main culprit of the state affairs manipulation scandal, has won the final lawsuit to cancel the gift tax of over 400 million won against the tax authorities.
On the 4th, the Supreme Court's 3rd Division (Presiding Justice Kim Jae-hyung) announced that it upheld the lower court's ruling partially in favor of the plaintiff in the appeal trial of the gift tax imposition cancellation lawsuit filed by Jung against the Gangnam Tax Office.
In 2017, when the tax authorities imposed a gift tax of 490 million won on four horses, the deposit for an apartment in Gangnam, the maturity refund of an insurance policy subscribed by Choi, and land in Hanam City purchased by Jung, she filed an administrative lawsuit.
The first trial held that the gift tax imposition was justified, considering that Choi had transferred ownership of the horses to Jung. However, it ruled that the gift tax imposition on the land in Hanam City was unjust and ordered the cancellation of about 170 million won.
The second trial's judgment differed. It ruled that the ownership of the horses could not be attributed to the plaintiff and ordered the cancellation of the gift tax of about 183 million won related to the horse purchase payment.
Both Jung's side and the tax authorities appealed, but the Supreme Court dismissed both appeals.
