[Asia Economy Reporter Kang Juhee] Former Dongyang University professor Jin Joong-kwon criticized President Moon Jae-in on the 3rd for emphasizing the 'procedural legitimacy and fairness' of the Ministry of Justice's disciplinary committee regarding Prosecutor General Yoon Seok-yeol, saying, "President Moon's mention of 'procedural legitimacy' is a kind of alibi-making."
In a post on his Facebook that day, former professor Jin said, "The problem lies in the legitimacy of the disciplinary committee itself, but what the president talks about is the legitimacy of the 'holding procedure' of the disciplinary committee."
He pointed out, "Here, the magic of language works," adding, "It makes people mistake the latter for the former. It deceives people into thinking that the dismissal was carried out through a legitimate procedure."
He continued, "If he had sincerity, he should stop the disciplinary committee itself as concluded by the Inspection Committee, because the disciplinary action violates due process," and analyzed, "But he did not do so. If the disciplinary committee is held, as Rep. Choi Kang-wook (Open Democratic Party) guarantees, a severe punishment, that is, dismissal, will be decided. Then President Moon's plan is to accept it as it is."
He added, "However, since the disciplinary action is so absurd, the court will later rule it 'invalid.' Then, the charge of abuse of authority will immediately arise. To avoid legal responsibility at that time, he is making an alibi that 'all procedures' were followed," criticizing, "It is just like holding a Moscow trial while trying to avoid judicial responsibility accordingly."
Earlier, according to Blue House spokesperson Kang Min-seok, President Moon said regarding Prosecutor General Yoon's disciplinary committee, "Considering the seriousness of the matter, the disciplinary committee must guarantee procedural legitimacy and fairness even more." He also emphasized, "Not allowing newly appointed Deputy Minister of Justice Lee Yong-gu to act as the chairman of the disciplinary committee will be a way to secure legitimacy and fairness."
However, some argue that since the court and the Ministry of Justice Inspection Committee have already concluded that the disciplinary procedure against Prosecutor General Yoon is unfair, proceeding with the disciplinary committee itself is inappropriate.
The disciplinary committee for Prosecutor General Yoon, initially postponed to today (the 4th), has been postponed again to the 10th.
