[Asia Economy Reporter Seongpil Cho] The hearing for the injunction application filed by Prosecutor General Yoon Seok-yeol, who opposed the suspension of duties by Minister of Justice Chu Mi-ae, will be held on the 30th.
The Administrative Court of Seoul, Administrative Division 4 (Presiding Judge Jo Mi-yeon) designated the hearing date for the injunction application filed by Prosecutor General Yoon against Minister Chu as 11 a.m. on the 30th. On the day of the hearing, the court will summon the Ministry of Justice and Prosecutor General Yoon’s side to submit necessary documents and examine the necessity of the injunction. Although there is no obligation for the parties to appear, the possibility that Prosecutor General Yoon will personally attend the court cannot be ruled out.
Legal circles expect the court to reach a conclusion quickly, considering the gravity and unusual nature of the case. If the court recognizes the urgent need to suspend the effect or execution of the disposition in the injunction case, it can deliver a decision within a week. It is even possible on the day of the hearing.
For the injunction application against the suspension of duties to be accepted, "irreparable harm" must be recognized. Based on this point, legal experts predict a high possibility that the injunction application will be granted. Since the six allegations of misconduct cited by Minister Chu as grounds for the suspension will be fully contested in the main lawsuit, it is expected that they will not significantly affect the injunction hearing.
Earlier, on the afternoon of the 25th, Prosecutor General Yoon applied for an injunction to halt the effect of the suspension, and the next day he filed a lawsuit seeking cancellation of the suspension order. In the lawsuit, Yoon argued that the six reasons presented by Minister Chu as grounds for the suspension were factually incorrect and that the procedure was illegal because he was not given sufficient opportunity to explain.
