[Asia Economy Reporter Hyunju Lee] Penalties will be strengthened for those who take disadvantageous measures against victims of sexual violence in the workplace.


The Ministry of Gender Equality and Family announced that the partial amendment to the "Act on the Prevention of Sexual Violence and Protection of Victims" containing these provisions passed the National Assembly plenary session on the 24th.


First, disadvantageous measures related to sexual violence have been clarified more explicitly. The current law stipulates that anyone employing a victim shall not take disadvantageous measures related to sexual violence, but the specific contents or scope of disadvantages other than dismissal were not specified. Accordingly, the scope of disadvantageous measures under the amended law includes seven areas: ▲personnel measures ▲performance evaluation ▲education and training ▲working environment and audit, and the details of the acts are also specified.

Furthermore, if an employer of a sexual violence victim violates this, the penalty will be increased from imprisonment of up to 3 years or a fine of up to 20 million won to imprisonment of up to 3 years or a fine of up to 30 million won.
