[Asia Economy Intern Reporter Kim Yeon-ju] Amid the Supreme Court's decision to remand the case of Gyeonggi Province Governor Lee Jae-myung, who was sentenced to disqualification from election in the second trial for false statement under the Public Official Election Act, actress Kim Bu-seon strongly criticized, saying "Not guilty? F*** you." Kim Bu-seon had previously engaged in a truth dispute with Governor Lee over the 'actress scandal.'


On the 16th, Kim Bu-seon posted on her Facebook, using profanity to harshly criticize, saying "Not guilty?"


Previously, Kim Bu-seon and Governor Lee had a truth dispute over a scandal claiming they were former lovers. Kim Bu-seon, who claimed they were in a relationship, mentioned a large mole on a part of Lee's body, which sparked controversy. Denying this, Governor Lee underwent a physical examination.


During the June 13, 2018 local elections, the 'Lee Jae-myung Camp Fake News Countermeasures Team' filed a complaint against Kim Bu-seon for false statement, and in response, Kim Bu-seon countersued Governor Lee for election law violations and false accusation.


Meanwhile, on the same day, the Supreme Court's full bench overturned the original ruling that sentenced Governor Lee to a fine of 3 million won for charges including violation of the Public Official Election Act, and remanded the case to the Suwon High Court. The original ruling, which found Governor Lee guilty for statements related to the forced hospitalization of his older brother, was overturned. Previously, in 2012, while serving as mayor of Seongnam, Lee was involved in a legal battle over allegations that he ordered the forced hospitalization of his older brother by the head of the public health center and a psychiatrist.


The Supreme Court's full bench stated, "(Governor Lee's) statements regarding the forced hospitalization of his brother were made in the process of explaining suspicions raised by the opposing candidate's questions and as a preemptive response to a second suspicion," adding, "If Governor Lee's statements are evaluated retrospectively, the scope of expression would be excessively expanded, harming predictability, so such statements cannot be punished under the false statement offense stipulated in Article 250, Paragraph 1."


Furthermore, it ruled, "The second trial's judgment that the forced hospitalization statements constituted false statement was a legal error that affected the verdict."
