Ministry of Government Legislation Publishes Collection of Legal Interpretation Cases


[Asia Economy Reporter Moon Chaeseok] The Ministry of Government Legislation announced on the 16th that it has published the '2019 First Half Year Legal Interpretation Casebook.'


Legal interpretation is a system designed to provide guidelines within the government regarding the meaning of legal provisions when there is a disagreement between the central administrative agency in charge of the law and the requester of the legal interpretation.


Since 2010, the scope of legal interpretation requests has been expanded to include civil petitioners.


The casebook contains 172 cases interpreted upon requests from central administrative agencies, local governments, and civil petitioners, categorized by field.


The casebook also includes 33 cases of proactive interpretation that avoid unnecessary expansion of regulatory targets and expand the meaning of provisions related to enhancing public convenience, which administrative agencies can use as guidelines for proactive administration.


The casebook will be distributed to the legal affairs departments of each central administrative agency and local government, and is scheduled to be made available on the Ministry of Government Legislation’s website by the end of this month.


The Ministry of Government Legislation stated that it plans to continue making efforts this year to provide fair and objective legal interpretations regarding questions about laws with a proactive attitude.
