Gyeonggi Province is pursuing the 23rd amendment to the Gyeonggi Province Standard Regulations for Apartment Housing Management to strengthen resident protection and ensure more efficient apartment housing management.
The draft amendment, which contains a total of 51 revision items, focuses on addressing recurring inconveniences and institutional shortcomings that have been consistently raised in the course of apartment housing management.
In terms of key changes, the terminology of "Gap/Eul" in contracts will be revised to "trustor/trustee," among others, in order to establish a more horizontal and equal contractual relationship.
A new provision will be established to allow for suspension from duty in cases where the prohibition on concurrently serving as both building representative and member of the election management committee is violated. The procedures for viewing and providing recorded materials from video information processing devices will also be clarified to strike a balance between personal data protection and information disclosure.
To further strengthen personal data protection, a consent form for the collection and use of personal data will be newly included in all templates of the standard regulations, requiring the consent of data subjects such as residents when their personal data is collected. In addition, realistic institutional improvements will be implemented in parallel, such as clarifying the deadline for holding by-elections for building representatives and extending the validity period for candidate photo shoots.
To improve management culture and enhance the substance of operations, the residents' representative council will be prohibited from issuing unreasonable work instructions to the management entity without a resolution or legal basis, and measures will be prepared to prevent damage caused by misconduct by accounting staff of housing management companies.
For transparent accounting management, the method for disclosing details of management fee and operating expense usage will be specified, and compliance with the approved budget range will be required when placing orders for construction and service contracts. In addition, the long-term repair reserve fund will be improved to an evenly accumulated annual contribution method to reduce volatility in cost burdens for households.
Regarding the recent social issue of inter-floor noise, the role of the Inter-floor Noise Management Committee will be strengthened and the dispute mediation procedures will be detailed step by step to enhance the effectiveness of dispute resolution. The amendment also includes detailed improvement measures across overall management, such as requiring the election management committee to be notified of households that are more than three months in arrears on management fees, and refining the consent form templates for the collection and use of personal data.
In addition, the province plans to reflect in the amendment the results of discussions with related organizations and legal experts on whether to abolish the current system that allows for suspension from duty when a dismissal is requested for building representatives and others, and whether to introduce exemption clauses for minor negligence that occurs in the course of performing duties.
Gyeonggi Province plans to finalize the amendment after collecting opinions from cities, counties, and related organizations through mid-March, and then implement it in April 2026 following deliberation by the Gyeonggi Province Apartment Housing Management Regulations Standards Deliberation Committee.
Lim Gyuwon, head of the Gyeonggi Province Apartment Housing Division, said, "Through this amendment, we will further strengthen the transparency and accountability of apartment housing management," adding, "We will establish a solid institutional foundation that will substantially contribute to protecting the rights and interests of residents and preventing disputes."
