"Is Imprisonment Possible or Not?"... Attorney Analyzes Charges Against Park Narae

Attorney Jang Hyuno Analyzes "Prison Sentence Risk Score"

A practicing attorney has predicted the possibility of a prison sentence for broadcaster Park Narae, who is facing allegations of receiving illegal medical procedures through a so-called "Injection Aunt."

Jang Hyuno, Managing Attorney at SK Law Office, analyzed the situation from a legal perspective in a video titled "[Park Narae Full Summary] The Reason Why Park Narae Does Not Apologize," which he uploaded to his YouTube channel on January 14. Attorney Jang viewed the core of this incident not as a dispute over settlement payments, but rather as an "emotional conflict." He stated, "Park Narae's biggest mistake was not reaching a settlement at the beginning of the incident," adding, "The managers know a lot about Park Narae's serious criminal circumstances. She should have tried to reconcile with the managers by any means necessary."


Regarding the most controversial issue-the illegal medical procedure, known as the "Injection Aunt" controversy-he said, "From this point on, it seems that the former managers exposed the issue out of emotional conflict," and continued, "A manager's role is to manage, control, and assist with a person's schedule. If something goes wrong, the managers could also become entangled. The fact that they exposed this, even at the risk of their own punishment, shows that pride and emotional conflict escalated to the end." He added, "This could be punishable as aiding and abetting or as a joint offender."


Attorney Jang analyzed the charges against Park by converting them into a "prison sentence risk score (out of 100 points)." His criteria were: ▲Moral wrongdoing (0-20 points), ▲Administrative fines or penalties (20-40 points), ▲Fines or suspended sentences (40-80 points), and ▲Possibility of imprisonment (over 80 points).


Regarding Park's alleged wage arrears, Attorney Jang said, "If wages are continuously unpaid and a labor inspector intervenes, it can lead to criminal prosecution," assigning a score of 50 points. On the embezzlement charge, he explained, "It depends on the amount, but it can be considered around 70 points. Although imprisonment is rare, it is clearly a crime." Concerning the "Injection Aunt" controversy, he said, "If it is a first offense, a suspended sentence is often given, so prison is possible but not certain," assigning a score of 80 points. He further commented, "Whether to add or subtract one point from 80 depends on how she responds." Regarding the special injury charge, he stated, "Whether a settlement is reached is key. If no settlement is reached, the risk increases," assigning a score of 75 points.


However, regarding the controversial "specific act inside a vehicle," he said, "Some actions known as sexual harassment do not constitute a crime and are at the level of an administrative fine, about 30 points," and added, "I am not sure what this act refers to, but if a specific act such as public indecency is confirmed, the level of punishment could change. Generally, however, it is limited to an administrative fine."


Attorney Jang stated, "Because these are concurrent offenses, there is a possibility of imprisonment. If things continue as they are, there is a possibility of a prison sentence," and advised, "I have some advice. The path to reconciliation or settlement is becoming more distant, and the conflict is intensifying. As a result, additional revelations are emerging. Considering the risk of imprisonment, this is not a good direction at all. For the sake of her future, I hope she will settle what can be settled and consult closely with her attorney to avoid the worst possible outcome," emphasizing the need to resolve the situation.


Meanwhile, Park's former managers claimed that during their employment, they suffered "abuse of power" including ▲workplace bullying, ▲special injury, ▲proxy prescriptions, and ▲non-payment of operational expenses. They reported Park to the authorities on charges including ▲special injury, ▲defamation by stating false facts, ▲violation of the Information and Communications Network Act, and ▲violation of the Act on the Aggravated Punishment of Specific Economic Crimes (embezzlement). In response, on December 5 of last year, Park filed a complaint with the Yongsan Police Station in Seoul against her former managers for attempted extortion, and on December 20, she filed an additional complaint against them for occupational embezzlement.
