The Ministry of Culture, Sports and Tourism announced on November 3 that it has produced and will distribute English versions of two guides worldwide: the "Guide to Copyright Registration for Works Utilizing Generative Artificial Intelligence," and the "Guide to Preventing Copyright Disputes Arising from Generative Artificial Intelligence Outputs," both originally released in June.
With the proliferation of generative artificial intelligence (AI) leading to increasingly diverse issues and a greater potential for disputes in the field of copyright, the ministry explained that it created the English versions of these guides to address questions that AI service providers, rights holders, and general users may have, and to take the lead in international discussions on AI and copyright.
The registration guide includes information on whether outputs generated by generative AI can be registered for copyright, details on the registration process (such as eligible registrants and the effect of registration), and sample cases.
The dispute prevention guide provides the basic legal principles for determining copyright infringement, factors to consider when assessing whether generative AI outputs infringe on copyright, and subject-specific points of caution for rights holders, users, and AI service providers to help prevent copyright-related disputes.
The ministry plans to actively distribute the English versions through international organizations and events to raise awareness of its policies. First, at the World Intellectual Property Organization (WIPO) Standing Committee on Copyright and Related Rights (SCCR) to be held in Geneva, Switzerland from December 1 to 5, the ministry will introduce the publication of the registration and dispute prevention guides during its national statement. In addition, the ministry plans to share the main content of the guides and discuss policy cooperation through meetings with major countries such as the United States and China attending the committee.
The English versions of these guides are available for download by any overseas creators or industry stakeholders from the English websites of the Ministry of Culture, Sports and Tourism, the Korea Copyright Commission, and the Korean Culture and Information Service.
