Six-Month Prison Sentence with One-Year Suspension Upheld on Appeal

A woman in her 30s who was indicted for instigating an assault by a former classmate-who was acquainted with her children-against two boys who had assaulted her own sons, has been sentenced to prison in the second trial as well.


According to Yonhap News Agency, the Second Criminal Division of the Chuncheon District Court (Presiding Judge Kim Seongrae) dismissed the appeal filed by Ms. A (39, female), who was charged with instigating assault, and upheld the original verdict, which included a six-month prison sentence suspended for one year.

In early February 2022, in Wonju, Gangwon Province, Ms. A instigated Mr. B, a classmate of her son, by saying, "If you are a middle school classmate of my son, shouldn't you take revenge for him? Find everyone who hit my son and beat them up," or words to that effect.


As a result, Mr. B repeatedly assaulted two individuals, including Mr. C (16). Investigations revealed that Ms. A committed this act out of resentment after her own son was assaulted by Mr. C and another boy about a month earlier. In court, Ms. A denied the allegations, stating, "I did not instigate the assault," but the court did not accept her claim.


The Wonju Branch of the Chuncheon District Court, which handled the first trial, considered the testimony of Mr. D as the most crucial evidence supporting the charges. Mr. D testified, "Starting three days after the joint assault incident involving Ms. A's child and Mr. B and Mr. C, I received several phone calls from Ms. A asking if I could bring in the kids who beat up her children."


He also testified that "Ms. A said things like, 'I could call in the local gangsters to take care of this,' which frightened me and ultimately led to the assault on Mr. B and Mr. C."


The first trial court criticized, "Attempts at unlawful self-remedy lead to a vicious cycle of violence and undermine the foundation of the rule of law. The defendant neglected the responsibilities and status of an adult and involved minors in the incident, for which she must be held appropriately accountable."


Ms. A, dissatisfied with the first trial verdict, continued to assert her innocence in the appeals trial. However, the appellate court found the original judgment to be correct.
