Lee Jinsook Completes First Police Interrogation... "Will Request Court Review of Arrest Legality Tomorrow"

On October 2, police concluded their first interrogation of former Korea Communications Commission Chairwoman Lee Jinsook, approximately three hours after her arrest. Lee's legal team announced plans to request a review of the legality of her arrest, claiming that the police action was unjustified.

Attorney Lim Mooyoung, representing Lee, met with reporters at Yeongdeungpo Police Station around 9:15 p.m. and stated that Lee had completed her questioning between approximately 6:00 p.m. and 9:00 p.m., after which she was placed in a detention cell.


He also noted that the police investigation would resume at 10:00 a.m. on October 3.


Attorney Lim said, "Due to the limited time, we focused on establishing the facts regarding whether there was a substantive request for her appearance, rather than discussing specific criminal charges. The claim that she refused to comply despite an agreement to appear, which was used to obtain the arrest warrant, constitutes a false official document that deceived both the prosecutor and the judge. We will file for an immediate review of the arrest's legality tomorrow (October 3)."


He added, "If the police request a detention warrant, we hope the prosecution will exercise sound judgment and reject it."


Under current criminal procedure law, a review can be requested to determine whether an arrest or detention is lawful or unlawful.


This review process allows the court to assess whether a suspect's arrest or detention by investigative authorities is lawful and whether continued detention is necessary. If found to be unlawful or unjustified, the court can order the suspect's release.


The right to request such a review is granted to the suspect, their attorney, legal representative, spouse, or direct relatives. The judge who issued the arrest warrant is not permitted to participate in the review proceedings.


The court must question the suspect within 48 hours of receiving the application. The hearing date should be set as soon as possible, and a decision must be made within 24 hours after the conclusion of the hearing process.
