Kim Yonghyun's Objection to Special Prosecutor's Additional Indictment Assigned to Seoul High Court

Request for Stay of Execution Dismissed

An objection filed by Kim Yonghyun, former Minister of National Defense, regarding the additional indictment by the special prosecutor for insurrection has been received.

According to the legal community on June 24, Kim's objection was assigned to the Criminal Division 20 of the Seoul High Court (Presiding Judge Hong Donggi) on this day. The Criminal Division 20 will determine the validity of the objection.


Previously, on June 19, Special Prosecutor Cho Eunseok additionally indicted Kim on charges of obstruction of official duties by fraudulent means and instigation of evidence destruction, rather than the charges for which he had already been indicted, and requested the issuance of an additional arrest warrant.


In response, Kim's legal team protested, calling it a "separate indictment," and filed an objection and a request for a stay of execution with the Seoul High Court regarding the additional indictment.


According to the Special Prosecutor Act for Insurrection, the person under investigation or their attorney may file an objection with the Seoul High Court if the special prosecutor summons or investigates individuals unrelated to the case under investigation, or otherwise exceeds the scope of their duties. The Seoul High Court must decide to dismiss or accept the objection within 48 hours of its receipt.


Meanwhile, regarding the request for a stay of execution, the Seoul High Court dismissed it, stating that it is a matter to be decided by the Seoul Central District Court, which will handle the indictment.
