Former President Yoon Sukyeol, who has been sued for damages by around 100 citizens claiming psychological harm from the 12·3 Martial Law incident, requested the court to order a "security for litigation costs," but the request was denied.

According to the legal community on the 11th, Presiding Judge Lee Seongbok of the Seoul Central District Court Civil Division 2 rejected on the 10th the application for security for litigation costs that former President Yoon filed against attorney Lee Geumgyu, the legal representative for the "Preparatory Group for the Damages Lawsuit Regarding Yoon Sukyeol's Acts of Rebellion."
Previously, on the 5th, former President Yoon had filed an application for security for litigation costs against attorney Lee, who had claimed approximately 10 million won in damages.
According to Article 117 of the Civil Procedure Act, a defendant may apply for security for litigation costs if it is deemed necessary, such as when it is clear that the plaintiff's claim is unfounded. This serves as a safeguard to prevent unjust lawsuits by plaintiffs.
In other words, the court's decision to dismiss the application is interpreted as finding that the plaintiffs' claim for damages against former President Yoon is not clearly unfounded, and therefore the requirements for ordering security for litigation costs were not met.
Previously, the "Preparatory Group for the Damages Lawsuit Regarding Yoon Sukyeol's Acts of Rebellion" filed a lawsuit at the Seoul Central District Court on December 10 last year, seeking 100,000 won per person in damages from former President Yoon for psychological harm.
The preparatory group was formed by attorney Lee Geumgyu, who represented the National Assembly during former President Yoon's impeachment trial, and attorney Lee is representing the plaintiffs in this lawsuit.
