Statute of Limitations Resumes After Constitutional Court Dismissal... Expected to Expire in August
The prosecution has resumed its investigation into the case accusing former President Yoon Suk-yeol of violating the Public Official Election Act by allegedly making false statements regarding suspicions of stock price manipulation involving Deutsche Motors. This comes two years and seven months after the complaint was first filed.
According to the legal community on April 26, the Public Investigation Division 2 of the Seoul Central District Prosecutors' Office, led by Chief Prosecutor Cho Minwoo, has scheduled an investigation of the complainant in the election law violation case involving former President Yoon for May 1. Kim Hanmae, the head of Citizens' Action to Establish Judicial Justice, is expected to appear. The group filed the complaint with the Seoul Central District Prosecutors' Office in September 2022.
The group claimed that during the 2021 People Power Party presidential primary, former President Yoon made false statements to the effect that "Kim Keonhee only sequentially sold stocks that a stock price manipulator had purchased, and she never entrusted her account to anyone" in connection with suspicions of Deutsche Motors stock price manipulation involving his spouse, Kim Keonhee. On this basis, they filed a complaint with the prosecution against former President Yoon.
Additionally, the group argued that former President Yoon's statement during a primary debate?"Before our marriage in 2010, I entrusted the account to this person, who was said to be from Goldman Sachs, for about four months, but there was a loss"?contradicts the prosecution's investigation results, which found that Kim Keonhee's account was used for 15 months from January 2010 to March 2011.
This case was suspended during the presidential term due to the immunity from prosecution granted to the president, which halted the statute of limitations. The statute of limitations for election law violations is six months after the election day. As President Yoon was removed from office by a Constitutional Court decision on April 4, the statute of limitations has resumed and is expected to expire in August.
