All Bail Requests Also Dismissed
Former Minister of National Defense Kim Yong-hyun, who was indicted and detained on charges of insurrection, requested again to have his detention revoked and to be tried while not in custody, but this request was also denied.
According to the legal community on the 1st, the Criminal Division 25 of the Seoul Central District Court (Presiding Judge Ji Gui-yeon) dismissed Kim's second request for detention cancellation on the 28th of last month. The decision was sent to Kim's side on the 31st of last month.
Kim had previously filed a request for detention cancellation once, but the court dismissed it in February, stating "no grounds." Subsequently, during the third preparatory hearing for the trial on charges including participation in important tasks of insurrection, Kim's side cited the illegality of the emergency arrest and announced, "We will reapply for detention cancellation," and refiled the request on the 13th of last month.
In January, he also requested bail (release under conditions such as a deposit), but it was not accepted in both the first trial and the appeal.
Thus, all of Kim's applications to date?including the Central Election Commission server evidence preservation application, the quasi-appeal against the ban on non-lawyer visits and letter exchanges, bail, appeal against bail denial, and the first and second detention cancellation requests?have been dismissed or rejected. Currently, at the Seoul Administrative Court, a lawsuit filed by Kim against the Seoul Central District Prosecutor's Office chief regarding the cancellation of the order to submit investigation records is ongoing.
