Constitutional Court Rules 'Ma Eun-hyeok Infertility Appointment' Unconstitutional... Democratic Party Urges "Immediate Appointment"

On the 27th, the Democratic Party of Korea urged, "Humbly accept the Constitutional Court's decision and immediately appoint Ma Eun-hyuk as a Constitutional Court Justice," following the Constitutional Court's ruling that Acting President and Deputy Prime Minister for Economy and Minister of Strategy and Finance Choi Sang-mok's refusal to appoint nominee Ma Eun-hyuk infringed upon the National Assembly's authority.

Cho Seung-rae, the Democratic Party's chief spokesperson, stated in a commentary that "the Constitutional Court unanimously declared that the refusal to appoint nominee Ma violated the National Assembly's authority and the Constitutional Court's composition rights."


Cho added, "The appointment of a Constitutional Court Justice elected by the National Assembly is the president's duty," and emphasized, "The Constitutional Court has made it clear that it cannot refuse or selectively appoint justices."


He said, "Today's decision by the Constitutional Court serves as a warning to the Choi acting administration, which arbitrarily judged and ignored the National Assembly's decisions," and added, "Han Duck-soo and Acting President Choi, who have shaken the separation of powers by disregarding the National Assembly's legitimate authority until now, must apologize to the National Assembly and the people." He further stated, "The People Power Party, which has itself diminished the authority and dignity of the National Assembly, must also apologize."


He then emphasized, "If Acting President Choi continues to refuse the appointment of nominee Ma as a Constitutional Court Justice, he will be sternly warned that he must bear responsibility for abandoning his constitutional duty to uphold the constitution."
