The main perpetrator of the 'elementary school student kidnapping and murder case' that occurred in Incheon 8 years ago filed a civil lawsuit while serving time in prison, claiming he was sexually assaulted by a private academy instructor when he was a middle school student, but ultimately lost the case.
According to Yonhap News on the 14th, Judge Park Jin-young of the Incheon District Court Civil Division 21 ruled in the sentencing trial that Kim Mo (25, female), the main perpetrator of the elementary school student kidnapping and murder case, lost the damages lawsuit she filed against A, a man in his 60s who was her former private academy instructor.
Judge Park stated, "The plaintiff's claim is dismissed," and "The plaintiff shall bear the litigation costs." Neither Kim nor A appeared in court that day, and Judge Park did not explain the specific reasons for the plaintiff's loss.

Kim abducted B (a second-grade elementary school student living in the same apartment complex, 8 years old at the time of death) from a park in Yeonsu-gu, Incheon, on March 29, 2017, took her to her home, murdered her, then brutally mutilated and abandoned the body. At the time of the crime, Kim was 17 years old and had dropped out of high school. In 2018, the Supreme Court sentenced her to 20 years in prison, and she has been serving her sentence since then. Park Mo (27, female), who was indicted alongside Kim on charges including murder as an accomplice, was sentenced to 13 years in prison after admitting only to aiding the crime.
Earlier, while incarcerated in 2022, Kim filed a civil lawsuit at the Incheon District Court demanding 30 million won in compensation from A. She claimed that between 2013 and 2015, when she was a middle school student attending a private academy in Dongchun-dong, Yeonsu-gu, she was sexually assaulted multiple times by A, the instructor.
Three months after filing the civil lawsuit, Kim also filed a police complaint against A for violating the Act on the Protection of Children and Youth Against Sexual Offenses and the Child Welfare Act. However, the prosecution, which took over the case from the police, decided in August 2023 not to indict A due to insufficient evidence of sexual assault.
