Na Kyung-won, a member of the People Power Party, criticized the High-ranking Officials' Crime Investigation Unit (PCC), which executed an arrest warrant against President Yoon Suk-yeol, calling it a "lawless land."
On the 3rd, Na posted on her social media account, "A real rebellion is happening right now. The series of procedures following the declaration of martial law are destroying the rule of law." She claimed, "When I was the floor leader, I strongly opposed the PCC, an institution that should never have been established. Now, the PCC, as the Democratic Party wishes, is arbitrarily trampling on the law, obtaining arrest warrants, and carrying out executions."
She continued, "The PCC does not have the authority to investigate treason. Moreover, the 'Joint Investigation Headquarters (PCC + police)' is an organization not stipulated by law," adding, "On what grounds does the PCC demand the president's appearance three times, request an arrest warrant, and incite public opinion? Despite this, they have continued their excessive investigation beyond the law and are now determined to execute the arrest warrant obtained through a judge affiliated with the Uri-beop Research Association." She emphasized, "In short, this is a lawless land. By their standards, isn't this rebellion? The PCC must immediately stop its illegal forced investigation."
On the same day, around 6:14 a.m., the PCC departed from the Government Complex Gwacheon in five vehicles to execute the arrest warrant against President Yoon. Due to traffic congestion and other factors, they arrived around 7:24 a.m. in front of the presidential residence in Hannam-dong, Yongsan-gu, Seoul, but after a standoff with the Security Office, they ultimately abandoned the execution.
In a statement to reporters, Yoon's legal team, represented by lawyer Yoon Gap-geun, argued, "If the PCC executed an unconstitutional and illegal warrant with police cooperation, it constitutes the criminal act of illegal detention under Article 124 of the Criminal Act." They also stated, "There is no precedent in constitutional history worldwide where the exercise of 'national emergency powers' such as martial law by a 'president' has been punished as treason. The PCC, which lacks treason investigation authority, has an invalid warrant request and issuance, and executing it is also illegal. Evidence obtained through illegal warrant execution loses all evidentiary value as illegally collected evidence." Furthermore, they emphasized, "Excluding the application of Articles 110 and 111 of the Criminal Procedure Act is clearly a judge's decision to suspend the effect of the law. Only the Constitutional Court can make judgments and decisions that suspend the effect of laws; anything else falls within the legislative domain."
