Seosamseok, Leads the Proposal of the 'Martial Law Prevention Act' National Assembly Member Seo Sam-seok.

Amid growing public anxiety caused by political and social turmoil as well as economic and diplomatic uncertainties following President Yoon Seok-yeol's declaration of martial law, a legislative amendment is being pursued to prevent such occurrences.


On the 6th, Seo Sam-seok, a member of the Democratic Party of Korea representing Yeongam, Muan, and Sinan in Jeollanam-do, officially proposed the "Martial Law Act Amendment" containing these provisions.


On the night of the 3rd, President Yoon Seok-yeol declared martial law citing the need to eradicate pro-North Korean and anti-state forces and attempted to seize control of the National Assembly; however, it was lifted after six hours by a majority vote of the National Assembly members present in the plenary session.


Nonetheless, the public remains anxious, fearing a re-declaration of martial law. Under current law, the president may declare martial law after a Cabinet meeting to maintain public peace and order during wartime, armed conflict, or equivalent national emergencies. While the National Assembly can demand its lifting by a majority vote of its members, there is no legal basis to restrict repeated declarations.


The amendment prohibits the declaration of a "re-martial law" with the same comprehensive intent if the National Assembly has already requested the lifting of martial law.


Representative Seo stated, "Although the Republic of Korea faced a dire crisis, fortunately, the courageous citizens and conscientious military and police officials were able to prevent the situation."


He added, "I prepared this amendment to alleviate public anxiety over a second martial law declaration and will lead efforts with all my strength alongside the people to ensure no further misfortune occurs. We must wisely overcome the current crisis solely for the people."
