The chamber stated that Prime Minister Netanyahu and Defense Minister Galant committed crimes against humanity from October 8, 2023, until May 20, 2024, the date on which the ICC prosecutor requested the arrest warrants.

The court explained regarding the charges against the two, "There is reasonable grounds to believe that from October 8, 2023, to May 20, 2024, they intentionally and deliberately deprived the civilian population of Gaza of essential items for survival, including food, water, medicine and medical supplies, fuel, and electricity," adding, "As a result of their actions, humanitarian organizations' ability to provide food and other essentials to those in need in Gaza was disrupted."

Furthermore, the chamber stated, "The shortage of food, water, electricity, fuel, and certain medical supplies created conditions destructive to some civilians in Gaza," and "There is reasonable grounds to believe that civilians, including children, died from malnutrition and dehydration."

The chamber also assessed, "There is reasonable grounds to believe that the two bear criminal responsibility as civilian superiors for war crimes in directing intentional attacks against civilians in Gaza," emphasizing, "There is reasonable grounds to believe that they failed to take measures to prevent or repress the commission of these crimes despite having the ability to do so."
