Anti-Circumvention Measures to Take Effect in January Next Year... "Investigation Period Reduced by Up to 4 Months"

Ministry of Industry Publishes 'Notice Amendment Proposal and Investigation Application Form'

The government will disclose the related notice and investigation application form for the 'Circumvention Dumping Prevention System' set to be implemented in January next year.


The Trade Commission of the Ministry of Trade, Industry and Energy announced on the 15th that it will hold a 'Public Meeting for Opinions on the Notice and Investigation Application Form Related to Circumvention Dumping Prevention' at the Korea International Trade Association.

Circumvention dumping refers to the act of slightly altering the physical characteristics or form of goods subject to anti-dumping duties without changing their essential characteristics, in order to evade anti-dumping duties. The Trade Commission, Ministry of Economy and Finance, Korea Customs Service, and the National Assembly have collaborated across related ministries to amend customs laws, establishing provisions for ex officio investigations and legal grounds for circumvention dumping prevention that reduce the existing procedures by up to four months.


At this meeting, a draft revision of the notice containing detailed provisions for the operation of the circumvention dumping prevention system was disclosed. According to this, applications for circumvention dumping investigations can be made by 'the original applicant or those who have expressed support for the investigation application.' The revision also stipulates ▲ notification to related agencies of the receipt of the investigation application within 14 days ▲ submission of stakeholders' opinions on the scope of the investigation target goods within 3 weeks ▲ submission of investigation participation applications by suppliers of the investigation target goods within 2 weeks.


Lee Jae-hyung, Chairman of the Trade Commission, said, "Rapid implementation of the circumvention dumping system is necessary to enhance the effectiveness of anti-dumping duties," adding, "We will strive to complete the revision of the notice within this year through continuous communication with companies and other stakeholders to ensure the circumvention dumping prevention system is implemented smoothly."
