"To Use Videos Filmed by Autonomous Vehicles and Robots for AI, Filming Must Be Disclosed"

'Guide for Mobile Video Information Processing Devices' Released

In the future, when capturing personal video information using mobile video information processing devices such as cameras mounted on autonomous vehicles and delivery robots for the development of autonomous driving artificial intelligence (AI), the fact of filming and specific details must be indicated.


The Personal Information Protection Commission has released the "Guide for the Protection and Utilization of Personal Video Information for Mobile Video Information Processing Devices" (hereinafter referred to as the Guide). It reflects the specific application standards of the newly established mobile video information processing device clause (Article 25-2) in the Personal Information Protection Act enacted last September, as well as inquiries from the industry.

First, eight basic principles that video device operators must comply with when processing personal video information for work purposes were presented: ▲Proportionality ▲Legality ▲Transparency ▲Safety ▲Accountability ▲Purpose Limitation ▲Guarantee of Control Rights ▲Privacy Protection.


The guide provides recommended methods for processing personal video information to prevent personal information infringement and various recommendations. For example, in the case of autonomous vehicles, it is required to indicate that filming is in progress and the filming entity on the front and both sides of the vehicle exterior.


It also guides developers of products and services related to mobile video information processing devices on measures to be taken to protect personal information when utilizing personal video information for AI learning. When using videos of unspecified many people filmed in public places by autonomous vehicles, delivery robots, etc., for AI learning, the videos must, in principle, be pseudonymized (such as face mosaic processing) so that specific individuals cannot be identified before use. However, if the use of original video footage is unavoidable to achieve research purposes, the original video can be used for autonomous driving AI development under the condition that all safety measures presented by the Personal Information Protection Commission are complied with through the regulatory sandbox (regulatory exemption system) demonstration exception system.


The newly released guide was prepared by comprehensively reflecting current laws and regulations and the latest domestic and international technological trends through collecting opinions from various sectors. It will be continuously improved and supplemented according to future amendments to related laws and the development of AI technology.


Yang Cheong-sam, Director of the Personal Information Policy Bureau at the Personal Information Protection Commission, said, "We hope that developers of products and services for mobile video information processing devices will refer to this guide to promote the safe industrial use of personal video information while paying close attention to prevent infringement of the rights of data subjects, thereby securing consumer trust and strengthening global competitiveness."
