SundayRed Trademark Registration Ban at US Patent Office
Appeal for Sanctions on SundayRed Consumer Confusion and Market Disruption
The golf apparel brand ‘Sunday Red’ of ‘Golf Emperor’ Tiger Woods (USA) has become embroiled in a trademark dispute.
Portable cooling system manufacturer Tiger Rare filed a complaint on the 29th (local time) with the U.S. Patent and Trademark Office, requesting to block the registration of the Sunday Red trademark, claiming "Sunday Red infringed on our trademark rights." Sunday Red is a golf apparel brand launched in May in collaboration with TaylorMade and Woods. It uses a tiger-shaped logo symbolizing Woods.
Tiger Rare has been using a tiger-shaped logo for the past four years. They claim, "The Sunday Red logo is too similar, causing consumer confusion and market disruption." Tiger Rare explained that during the Masters in April, people wearing Tiger Rare shirts were even asked how they got Sunday Red clothes. Tiger Rare stated, "The Sunday Red logo violates intellectual property law," and urged the patent office to reject Sunday Red's trademark registration.
TaylorMade and Woods’ representatives declined to comment on the matter. Trademark attorney Josh Garvin predicted, "The Sunday Red trademark application process will be halted, but the product launch will likely continue. Tiger Rare is expected to resolve this issue through negotiations with TaylorMade and Woods. It probably will not go to trial."
