Court: "Prison Sentence Justified Due to Potential for Indiscriminate Distribution"
A man in his 20s was sentenced to prison for uploading explicit videos of his ex-girlfriend to an adult website.
The Cheonan Branch of the Daejeon District Court Criminal Division 1 (Presiding Judge Jeon Kyungho) sentenced Mr. A (22), who was indicted without detention on charges of violating the Act on the Protection of Children and Juveniles from Sexual Abuse (production and distribution of obscene materials, etc.), to four years in prison and ordered his immediate detention in court. Additionally, the court ordered Mr. A to complete 80 hours of sexual violence treatment programs and imposed a seven-year employment restriction at institutions related to children, juveniles, and persons with disabilities.
Mr. A began dating Ms. B, who was 14 years old at the time, in 2018 and filmed 67 videos and photos exposing Ms. B’s face and body. In January 2022, after breaking up with Ms. B, he uploaded three of the videos taken during their relationship to a pornography website.
The court stated, "At the time, the defendant was also a minor under the age of 19, with immature judgment and an incomplete personality, and appears to have committed the crime under these circumstances." The court added, "Given the development of information and communication technology, child and juvenile pornography can be distributed indiscriminately at any time regardless of intent. Therefore, even if a substantial settlement was paid, a prison sentence is warranted."
