Prosecution Seeks Heavy Sentence Again in Second Trial... Same as First Trial Request

The prosecution requested a 15-year prison sentence again in the second trial for a club DJ who was charged with causing the death of a motorcycle delivery worker by driving under the influence of alcohol.


According to the legal community on the 7th, the prosecution asked the Seoul Central District Court Criminal Appeal Division 5-2 (Presiding Judges Kim Yong-jung, Kim Ji-sun, and So Byung-jin) to sentence DJ An Mo to 15 years in prison during the closing arguments. This is the same as the sentence requested in the first trial.

The prosecution explained the reason for the sentence request, stating, "The defendant drove under the influence in a densely populated area and fled the scene, causing great shock to society."


An’s defense attorney said, “The defendant admits all charges and is remorseful,” and added, “Looking at the circumstances, he drank excessively at a meeting with broadcasting industry personnel and drove in a state he does not remember. He feels a strong need for alcohol addiction treatment,” appealing for leniency.


He also stated, “The defendant does not remember driving after drinking. He cannot recall the first and second accidents,” and said, “He will quit drinking, give up his dream of being a DJ, and live sincerely in society from now on.”


In his final statement, An said, "I sincerely apologize to the victim who lost their precious life because of me and to the victim’s bereaved family," and added, "While serving time in detention, I have spent each day with feelings of guilt and reflection, looking back on my past."


He continued, "I regret my immature past and vow never to repeat the same mistake," and said, "I plan to give up both my job and my dream."


He added, "I reflect on my inexcusable wrongdoing and will accept any criticism," and said, "I will live with a repentant heart for the rest of my life."


Earlier, on February 3rd at around 4:30 a.m., An was arrested and indicted for driving a Mercedes-Benz under the influence in Nonhyeon-dong, Gangnam-gu, Seoul, and hitting delivery worker A (54), who later died. At the time, it was reported that he held his dog and failed to provide proper aid to the victim, which sparked controversy.


The first trial sentenced him to 10 years in prison, stating, "The defendant admitted the facts during the trial but denied the charge of failing to provide aid, offering excuses that were difficult to accept. It is questionable whether he is sincerely remorseful." The second trial verdict is scheduled for the 18th of next month.
