Workplace boss acquitted in first trial
A man in his 40s who falsely confessed to drunk driving on behalf of his superior at work was sentenced to a fine.
On the 22nd, Judge Kang Hyun-ho of the Criminal Division 4 at Cheongju District Court announced that A (48), who was prosecuted for aiding a criminal, was sentenced to a fine of 5 million won.
In November 2022, while riding in a vehicle driven by his superior B in Jincheon-gun, A lied that he was the one driving under the influence after B saw police officers conducting a sobriety checkpoint, got out of the car, and fled, and A submitted to the alcohol test.
He knowingly helped B escape despite being aware that B had driven under the influence for about 100 meters.
Because the alcohol test was not conducted in a timely manner, B was acquitted in the first trial.
The prosecution calculated the blood alcohol concentration using the Widmark formula based on the amount of alcohol consumed. However, the court did not accept the charges, citing that factors such as drinking speed, body constitution, and the amount of food remaining in the body were excluded.
Judge Kang explained the sentencing reason, saying, "Drunk driving is difficult to punish if the alcohol test is not conducted promptly. Nevertheless, the defendant did not correct the facts for a long time, which ultimately affected the investigation and trial of B."
He added, "This severely obstructed the state's judicial function to discover the substantive truth and should be strictly punished. However, considering the defendant’s remorseful attitude and that the crime was committed impulsively when the superior suddenly fled, the sentence was determined."
