Seoul National University Hospital Sends Resignation Agreement to Residents... "Resignation Processed if No Response"

Seoul National University Hospital sent a 'Resignation Agreement' containing specific details about the timing of acceptance of resignation letters and legal responsibilities to the residents who left.


According to the medical community on the 16th, the Education and Training Team at Seoul National University Hospital sent the 'Resignation Agreement' to residents who have neither returned nor expressed their intention to resign, requesting a reply by 6 p.m. that day. They also informed that if there is no response again, the resignation letters will be accepted.


The hospital decided to set the acceptance date of resignation letters as July 15, but the effective date of resignation as February 29. It is known that this separation of acceptance date and effective date was made by partially accepting the residents' requests.


Until now, major training hospitals have been strongly considering applying the acceptance date of resignation letters as 'after June 4' in accordance with government policy. The government emphasized that the 'legal effect' of resignation occurs after June 4, when the order to prohibit acceptance of resignation letters was lifted. On the other hand, residents have insisted that the resignation letters should be accepted as originally submitted in February.


The resignation agreement also includes a clause that the hospital will not hold the residents liable for any civil or criminal responsibility for the hospital's medical confusion and damages caused by the residents' absence.


At the same time, residents are required to return all amounts to be settled with the hospital, including salary deductions for absences this year and health insurance premium adjustments from last year, by August 31.


If residents do not respond to the resignation agreement and their resignation is processed, the legal effect of the resignation letter may also be applied as July 15, the same as the acceptance date.


The agreement also states that residents will not raise any civil, criminal, administrative, or other judicial claims, rights assertions, objections, or complaints against the hospital in relation to their employment contract in the future.


The hospital said, "Although it may vary depending on the residents' training period and laws, most will be processed as resignations as of July 15, and this is a matter decided according to the Ministry of Health and Welfare guidelines."


Meanwhile, as of the day before the deadline set by the government for residents to decide on return or resignation, confirmation with training hospitals showed that most residents have not yet returned and remain unresponsive to hospital contacts. The number of residents who have returned to work has not even increased to 50.


The Presidential Office and the government plan to persuade residents to return through training in the second half of the year (September) after processing resignations.


The training hospitals where the residents belonged are continuing to deliberate until the last moment on the collective resignation processing of non-returning residents, one day before confirming the resident vacancies.
