Analysis of Major Violations Through Case Law
Systematic Explanation of Response Procedures
A guideline has been released for small and medium-sized enterprises (SMEs) to comply with the Serious Accidents Punishment Act and refer to in case of emergencies.
The Korea Employers Federation (KEF) announced on the 14th that it has published two types of the "Practical Manual for Responding to the Serious Accidents Punishment Act."
First, "Key Checkpoints of the Serious Accidents Punishment Act Based on Prosecution and Judgment Cases" analyzes the main violations of obligations in cases prosecuted or judged for violations of the Serious Accidents Punishment Act to date. It is designed to enhance the understanding of small and medium workplaces by including not only the simple legal concepts but also the characteristics of cases prosecuted or judged for violations.
The "Serious Industrial Accident Response Procedure for SMEs" is structured to provide an overview of the response procedures when a serious industrial accident occurs. It consists of ▲ response procedures upon occurrence of a serious industrial accident ▲ investigation procedures for serious industrial accidents ▲ work stoppage order and lifting procedures ▲ appendix (example of serious industrial accident response manual).
The guidebook can be downloaded from the "Serious Accident Comprehensive Response Center" section on the KEF website.
Im Woo-taek, head of the KEF Serious Accident Comprehensive Response Center, said, "The manual published this time is a follow-up to the guidebook distributed last April and was created to strengthen on-site operability at small and medium workplaces. We will produce and distribute four additional guides for SMEs in the future and do our best to support safety management for SMEs."
