Court Sentences 5 Years Imprisonment
"Cannot Consider Crime Committed Under Diminished Mental Capacity"
An organized crime member who was released from prison assaulted his wife just two days after his release and forced her to tattoo his name on her body, resulting in a 5-year prison sentence in the appellate court as well.
On the 14th, Yonhap News reported that the Criminal Division 2 of the Gwangju High Court (Presiding Judge Lee Eui-young) dismissed the appeal of Kim Mo (29), who was charged with unlawful confinement causing injury, assault, and coercion. Kim was indicted for repeatedly assaulting his wife, A, at their residence in Buk-gu, Gwangju, in July last year. It was investigated that he suspected A of having an affair while he was in prison.
Kim, who was under organized crime supervision, was sentenced to 1 year and 6 months in prison for operating a gambling house and assaulted his wife two days after his full release. He also forced A to tattoo his name on various parts of her body.
Furthermore, Kim threatened the frightened A repeatedly by showing her the full-body tattoo of Lee Young-hak, known from the so-called ‘Eogeumni Appa’ (Molar Dad) case, saying, “If your feelings for me are sincere, tattoo it on your body like the ‘Eogeumni Appa’ tattoo,” and forcibly took her to a tattoo parlor. In fact, A tattooed phrases such as “I will live for Kim” on her wrists, legs, and other parts of her body.
The appellate court stated, “Although the defendant claims diminished mental capacity, considering the circumstances such as voluntarily calling to surrender after the crime, it cannot be seen that the crime was committed under a state of diminished mental capacity.”
Earlier, the first trial court on January ruled, “The defendant’s guilt is very serious as he confined his spouse at their residence, inflicted injury, and coerced her to tattoo large tattoos on multiple parts of her body through threats,” adding, “Considering the severity of the injuries and that even if there was an agreement, it is difficult to see that the damage has been fully recovered, the sentence was determined accordingly.”
Meanwhile, Lee Young-hak, known as the so-called ‘Eogeumni Appa’ (Molar Dad), was famous for his paternal love, blaming himself for passing on a rare disease called giant cell fibroblastoma to his daughter. Later, he was indicted for rape and murder, inducing molestation, and corpse disposal under the Act on the Protection of Children and Juveniles from Sexual Abuse after sexually assaulting and killing his middle school daughter’s friend, and was sentenced to life imprisonment.
