"Failed to Surpass Majority in 2nd Runoff Vote During Temporary General Meeting"

The Cheongju 'Osong Station Area District Urban Development Project Association,' which faced difficulties in project promotion due to bribery allegations against the former union president, has encountered another obstacle as the current president's duties have been suspended again.
On the 29th, the 21st Civil Division of the Cheongju District Court ruled in favor of member A in a provisional injunction lawsuit filed against the current president B to suspend his duties. The court also appointed auditor C as the acting president.
President B was elected at a special general meeting last December. At that meeting, out of 523 total members, 376 participated in the first vote, including 90 by proxy and 286 in person. In the first vote, B received the highest number of votes with 146 but did not achieve a majority, so a second vote was held according to the bylaws. In the second vote, 242 members voted, and B was finally elected with 124 votes.
However, member A argued that according to the bylaws, the election of the president requires a majority attendance of members and a majority approval of attending members, meaning that in both the first and second votes, B should have received at least 189 votes, which is the majority of 376 attendees. A filed the provisional injunction lawsuit to suspend B’s duties on this basis.
The court stated, “In the election of the president, the bylaws require a majority of votes from attending members, and this applies not only to the first vote but also to the second vote, which is a runoff vote as an extension of the main vote. While the bylaws provide an exception for the appointment of directors and auditors, where if no candidate receives a majority, the candidate with the highest votes is selected, no such exception exists for the president’s election. It is clear from the calculations that in the second vote, B did not obtain the majority of votes required by the bylaws from attending members.”
