Filming Apology Video After Live Fight Broadcast
Includes Charges of Defamation and Marijuana Smoking... 1-Year Prison Sentence
A famous rapper who live-streamed a fight with a junior colleague, with whom he frequently had conflicts, on the street was sentenced to prison.
Rapper A (26) engaged in a brawl with rapper B (21) in the early hours of February last year and live-streamed the fight scene in real-time on social media (SNS).
When the police arrived and stopped the fight, A went back to B, assaulted him by hitting his face and body multiple times and stepping on him with his foot, demanding an apology. He then filmed B, who was frightened, saying, “Hyung, I’m sorry. I won’t act cocky anymore,” on his phone and posted the video on his SNS.
According to the legal community on the 28th, Judge Seong Jun-gyu of the Criminal Division 10 at the Seoul Western District Court sentenced A (26) to one year in prison for violating the Act on Punishment of Violent Crimes (joint coercion) and other charges.
The day after the fight, A posted on his SNS referring to B, saying, “That guy hit me first,” and “He threatened to kill my father who was undergoing surgery, so I got hit first and started it, but while running away, he said you’re dead next time, so I caught him and only got an apology,” and he is also charged with defamation under the Information and Communications Network Act.
Judge Seong stated, “It is highly likely that the victim (B) was filmed against his will by the defendant (A) in the apology video,” and “It can also be seen as very likely that there was direct or indirect physical force exerted by the defendant during the process,” and thus ruled guilty.
Additionally, A was charged with violating the Narcotics Control Act (marijuana smoking) for smoking marijuana at a club in Yongsan-gu, Seoul, in September 2022. The court also ordered him to complete an 80-hour drug addiction rehabilitation program.
Judge Seong explained the sentencing reason, saying, “The defendant committed the same type of crime again despite having been sentenced to a suspended prison term for marijuana smoking and being under probation,” and “Considering the circumstances under which the victim’s apology video was filmed and posted, the nature of the crime cannot be considered light.”
