Shin Seong-sik, former chief prosecutor (58, Judicial Research and Training Institute class 27) who was dismissed after being indicted in the ‘Han Dong-hoon Recording Misinformation Incident,’ has filed a lawsuit to cancel his disciplinary action.

According to the legal community on the 24th, Shin filed a lawsuit to cancel the dismissal order against the Minister of Justice at the Seoul Administrative Court in early last month. The case was assigned to the Administrative Division 11 (Chief Judge Kim Jun-young), and a hearing date has not yet been set.


Shin also applied for a provisional injunction related to this matter on the 19th but is understood to have withdrawn the application on the same day.


Shin was prosecuted on charges of defamation for allegedly providing false information to KBS reporters about the conversation between Han Dong-hoon, chief prosecutor (former Emergency Response Committee Chairman of the People Power Party), and Lee Dong-jae, former Channel A reporter, while serving as the third deputy chief of the Seoul Central District Prosecutors' Office from June to July 2020.


The Ministry of Justice’s Prosecutor Disciplinary Committee held a disciplinary meeting in February and resolved to impose a dismissal on Shin for causing the ‘recording misinformation incident.’ Shin submitted his resignation in December last year and ran as an independent candidate in the 4.10 general election for the Jeonnam Suncheon, Gwangyang, Gurye, and Gokseong Gap electoral district but was defeated.


Lee Seong-yoon, a Democratic Party winner (61, Judicial Research and Training Institute class 23) who ran and won in Jeonbuk Jeonju-eul in the general election, is also reportedly considering filing a lawsuit to cancel his disciplinary action.


Last year, while serving as a research fellow at the Judicial Research and Training Institute, Lee made remarks criticizing the ‘Yoon Seok-youl faction’ at the publication event of Cho Guk, leader of the Cho Guk Innovation Party, and in media interviews, which led to a request for severe disciplinary action on grounds of undermining the fairness of the prosecution. The Ministry of Justice’s disciplinary committee resolved to dismiss Lee in February.


Additionally, Kim Sang-min, former prosecutor at the Daejeon High Prosecutors' Office (45, class 35), who received a three-month suspension for violating political neutrality, is also understood to have filed a lawsuit to cancel the suspension order at the Administrative Court in February.


Kim was disciplined after forcibly running for the general election while still a prosecutor but was cut off after failing to qualify in the People Power Party’s internal primary.
