Drunk Driving for 13km After Swinging a Blunt Object
A man in his 30s who attempted to kill a woman having an affair with his wife using a blunt weapon was sentenced to 2 years and 6 months in prison.
According to the legal community on the 16th, A (33), who was indicted on charges of attempted murder, submitted a withdrawal of appeal document to the Supreme Court the day before (the 15th), confirming the appellate court's ruling as final.
A is accused of going to the home of B (29), who was having an affair with his wife, around 2:20 a.m. on April 7 last year and swinging a blunt weapon at B in an attempt to kill her. About a month before the crime, A learned that his wife and B were having an affair and demanded that they end it, but his wife was still engaging in affectionate behavior with B even the day before the crime, which A discovered.
Determined to commit murder, A drove under the influence of alcohol to find B and committed the crime. After the crime, A got behind the wheel again and fled to Seosan-si, Chungnam Province. After a 13 km reckless chase, he was caught by police who responded to a report from his wife. At the time of arrest, A's blood alcohol concentration was 0.036%. A blood alcohol concentration between 0.03% and 0.08% results in license suspension and is punishable by up to one year in prison or a fine of up to 5 million won. During police investigation, A reportedly stated, "I saw my wife and B having an affair, got into an argument, and in a fit of anger, hit B with a blunt weapon."
A was sentenced to 2 years and 6 months in prison in both the first and second trials. The first trial court stated, "The crime was planned in advance, including preparing the blunt weapon, and the crime involved attempted murder followed by drunk driving, which makes the nature of the crime serious and highly blameworthy," but also said, "Considering that the victim did not want punishment, the sentence was determined accordingly." A appealed, claiming the sentence was too heavy, but the second trial court dismissed A's appeal, stating, "The original judgment does not exceed a reasonable range," and upheld the original ruling.
