One-time New Construction Allowed for Old Houses in Development Restriction Zones... Starting from the 13th

From the 13th, reconstruction will be allowed once for old and deteriorated buildings within the development restriction zone.


Gyeonggi-do announced on the 12th that the government-enacted "Enforcement Decree of the Special Measures Act on the Designation and Management of Development Restriction Zones," proposed by the province, will come into effect on the 13th.


Previously, constructing new houses in development restriction zones was very limited to land designated as site (daeji) at the time of designation, land with houses at the time of designation, land owned by the individual if demolished for public projects, or relocation to settlement districts.


Because of this, old houses built 20 to 30 years ago had to be continuously repaired, extended, or rebuilt with the same existing area.


Accordingly, Gyeonggi-do proposed amendments to the Enforcement Decree of the Development Restriction Zone Act three times since 2022.


With this amendment, if the local government head recognizes a building as old and deteriorated, reconstruction will be allowed once. In the case of reconstruction, it is possible to increase the number of floors or expand the area within the permitted range.


Additionally, small-scale simple restrooms of 5㎡ or less can now be installed even within development restriction zones.


Gyeonggi-do proposed to the government four times to allow the installation of small-scale simple restrooms of 5㎡ or less to alleviate the inconvenience of farmers working at agricultural production sites within development restriction zones.


According to this amendment, if the floor area is 5㎡ or less and concrete pouring and septic tank installation are not performed, farmers can install portable simple restrooms even in development restriction zones.


Other provisions in this enforcement decree include ▲installation of access roads using adjacent development restriction zone land when constructing houses and neighborhood living facilities in group settlements released from development restriction zones ▲expansion of road range necessary for snow removal facilities ▲allowing parking lots to be installed on land separated from restaurants.


Kim Su-hyung, Director of Regional Policy Division of Gyeonggi-do, stated, "We will continue to identify unreasonable systems to minimize residents' inconveniences in living and working environments, propose them to the government, and do our best to ensure improvements."
