The prosecution requested a reinvestigation after the police suggested a non-prosecution (no charges) opinion regarding an incident in which a person was injured while restraining an attack by a dangerous dog.
According to the legal community on the 15th, the Seoul Western District Prosecutors' Office requested a reinvestigation on the 5th concerning Mr. A, who is suspected of negligent injury under the Criminal Act. The police had sent the case records the previous day with a non-prosecution opinion.
Mr. B was attacked by Mr. A's pet Rottweiler while walking with his own dog in a mountain located in Eunpyeong-gu, Seoul, on the morning of October 18 last year. During the process of restraining the dog, Mr. B was injured and filed a complaint against Mr. A for negligent injury.
The Seoul Eunpyeong Police Station, which received the complaint, forwarded the case records to the prosecution on the 4th with a non-prosecution opinion, stating it was difficult to acknowledge Mr. A's negligence and the victim's injury.
After receiving the records from the Eunpyeong Police Station, the prosecution reviewed the investigation details, evidence, and legal principles comprehensively and determined that additional investigation was necessary to clearly establish whether Mr. A was negligent. Therefore, they requested a reinvestigation on the 5th.
