The prosecution has decided not to indict Ahn Hyeong-jun, president of MBC, who was accused of obstructing the audit work of the cable broadcaster CJ ENM.
On the 7th, the Criminal Division 5 of the Seoul Western District Prosecutors' Office (Chief Prosecutor Kim Jeong-hoon) announced that President Ahn, who was referred on charges of obstruction of business, was dismissed without indictment.
The prosecution explained the reason for non-indictment, stating, "Although it is acknowledged that President Ahn made false statements during the CJ ENM audit process, it is difficult to consider this fact alone as meeting the legal requirements of 'deception' for the crime of obstruction of business."
President Ahn was accused of obstructing CJ ENM's work by falsely testifying that he owned shares which were actually held by PD Kwak, a junior from his university at CJ ENM, who was under an internal audit over allegations of receiving shares from a partner company.
The police also applied obstruction of business charges to Kwak and referred him without detention, but the prosecution dismissed the charges against Kwak as well.
