Prosecution Appeals Second Trial Dismissal of Kim Geun-sik's Sexual Impulse Drug Treatment Request

The prosecution has filed an appeal against the appellate court's ruling that dismissed the sex impulse drug treatment for Kim Geun-sik, who was re-arrested on charges of forcibly molesting a child under the age of 13 seventeen years ago.

The Anyang Branch of the Suwon District Prosecutors' Office stated on the 22nd, "Despite the psychiatric evaluation results and the opinion of a specialist indicating that Kim Geun-sik requires sex impulse drug treatment, the appellate court dismissed the request for the sex impulse drug treatment order," adding, "The prosecution will make every effort to maintain the prosecution so that the treatment order can be imposed in the Supreme Court."


The Criminal Division 3-2 of the Suwon High Court (Presiding Judges Kim Dong-gyu, Heo Yang-yoon, Won Ik-seon) overturned the original sentence of two years imprisonment and sentenced Kim Geun-sik to a heavier sentence of four years imprisonment on the 15th in the appeal trial for violation of the Act on the Punishment of Sexual Crimes and Protection of Victims.


However, regarding the sex impulse drug treatment requested by the prosecution, the court dismissed it as in the original trial, stating, "Based solely on the evidence submitted by the prosecutor, it is difficult to conclude that the defendant requires sex impulse drug treatment and poses a risk of reoffending."


Kim Geun-sik is accused of forcibly molesting victim A, who was under 13 years old at the time, by hitting and threatening her with a weapon near an elementary school in Gyeonggi Province on September 18, 2006. Separately from the sex crime, Kim Geun-sik was also indicted for obstruction of official duties and habitual assault, for which he was sentenced to one year imprisonment in both the first and second trials. If the second trial verdict is finalized, Kim Geun-sik will serve a total of five years in prison. On the 20th, Kim Geun-sik filed an appeal with the court, and this case will now be subject to the Supreme Court's judgment.
