40s Son Sentenced to 2 Years, Daughter-in-Law to 1 Year

A man in his 40s and his wife were sentenced to prison for using their parents' ID cards and digital certificates, which were entrusted to them for insurance contract cancellations, to issue credit cards and freely spend money, even tampering with pension insurance.


On the 11th, the Criminal Division 1 of the Namyangju Branch of Uijeongbu District Court (Chief Judge Choi Chi-bong) announced that it sentenced the couple, Mr. A (43) and Mrs. B (43), who were indicted on charges of forgery of private documents and fraud, to two years and one year in prison, respectively. Immediately after the sentencing, Mr. A was taken into custody in court, but Mrs. B was spared from detention due to consideration of her young children.

Mr. A was tried on charges of secretly using mobile phones and credit cards created after receiving ID cards and digital certificates from his biological father Mr. C and biological mother Mrs. D around July 2019 for insurance contract cancellations, and embezzling money through secured loans. He exploited the fact that credit cards could be issued non-face-to-face by using ID cards, digital certificates, and mobile phones registered under the parties' names.


In December 2019, Mr. A opened a mobile phone account under his father Mr. C's name and used the phone as a verification method to issue credit cards. He even reissued credit cards from another company that his father did not use. Using these cards, he applied for card loans and embezzled 65.4 million won over 29 times for about a year, and made payments exceeding 90 million won at convenience stores and other places over 1,517 transactions with these cards.


Mr. A even extended his wrongdoing to the pension insurance his parents had subscribed to. From September 2019 to July of the following year, he borrowed more than 115 million won using Mr. C's pension insurance as collateral from four insurance companies. Eventually, he canceled the insurance and received a refund of about 38 million won.


Mrs. B, Mr. A's wife, was also found to have participated in some of the crimes by issuing cards under her mother-in-law's name and signing a vehicle installment contract together with Mr. A.


The couple Mr. and Mrs. C stated, "Just as parents cannot do as they please simply because the child is their own, children also cannot do as they please just because the parents are theirs," and demanded, "The defendant couple who stabbed their parents in the back and exploited them like straws are beyond unfilial and are impious children; please impose a heavy sentence so they can be isolated from society for a long time."


The court explained, "The couple admitted to all the crimes, and a significant portion of the direct damage caused by the crimes has been recovered, and the young son's poor health is a favorable circumstance," but also said, "Considering that they deceived their parents causing economic damage and continue to cause direct and indirect harm, that Mrs. B was substantially involved in her husband's crimes or shared economic benefits and thus bears considerable responsibility, and that they have not been forgiven by their parents, these factors were taken into account in sentencing."
