No Criminal Record Left Through Summary Trial
A woman in her 30s was caught by the police for falsely reporting to 112 that she was sexually assaulted by her boyfriend because she was angry that he did not answer her calls.
On the 10th, the Pyeongtaek Police Station in Gyeonggi announced that they referred Ms. A (female, in her 30s) to a summary trial on charges of violating the Minor Offenses Act (false report).
Ms. A is accused of making a false report to 112 around 1:10 a.m. the previous day in front of an apartment complex in Cheongbuk-eup, Pyeongtaek-si, Gyeonggi Province, claiming that she was sexually assaulted by her boyfriend.
When the police who arrived at the scene asked about the incident, Ms. A initially lied, saying "I think I was sexually assaulted," but eventually confessed to her crime. It is known that during the police investigation, she stated that she committed the act because she was angry that her boyfriend did not answer her calls and did not come to pick her up.
However, Ms. A avoided a criminal record. The police requested a summary trial considering that no victim was harmed due to her false report. A summary trial is a simplified trial procedure under the Act on Summary Trials for minor offenses (fines of 200,000 won or less) without going through formal criminal proceedings, and this disposition does not leave a criminal record.
A police official explained, "Three patrol cars were dispatched due to the report of sexual assault, but it was not true," adding, "Since it was immediately revealed to be a false report at the scene of the dispatch, no harm occurred to the boyfriend, who was the subject of the false report."
