"Stop Drinking" Said... 60s Son Sentenced for Assaulting 90s Mother Changwon District Court, Gyeongnam.

A man in his 60s who habitually assaulted his mother in her 90s was sentenced to 1 year and 6 months in prison again in the appellate court.


According to the Criminal Division 5 of Changwon District Court in Gyeongnam on the 1st, Mr. A was prosecuted for habitually assaulting his mother, Ms. B, from July 2021 to November last year.


In March last year, at a residence in Jinju City, when Ms. B told him, "Stop drinking," he twisted his elderly mother's neck and threatened to kill her while holding a weapon.


Despite having been subjected to family protection measures in 2016 for assaulting a family member, Mr. A frequently beat Ms. B when he drank, and was reported to the police eight times last year alone.


He assaulted Ms. B again while undergoing trial for this case.


The first trial court stated, "He habitually assaulted his elderly mother, and although the victim does not wish to press charges, considering the nature of the crime and the risk of reoffending, a prison sentence is inevitable."


Mr. A appealed, claiming the sentence was too harsh, but the appellate court upheld the original judgment.


The appellate court explained the dismissal, saying, "Even after carefully examining Ms. B's age, Mr. A's criminal record, and the motive for the crime, the original sentence appears appropriate."
