20s Smoking Marijuana at Home, Suspended Prison Sentence

A man in his 20s who smoked marijuana at home was sentenced to a suspended prison term.


The 12th Criminal Division of the Gwangju District Court (Presiding Judge Kim Sang-gyu) announced on the 23rd that A (26), who was indicted for violating the Narcotics Control Act (marijuana), was sentenced to 10 months in prison with a 2-year suspension.


He was also ordered to undergo probation and attend 40 hours of drug treatment lectures.

A was prosecuted for lighting and smoking marijuana using a plastic beverage container and aluminum foil at his residence in Mokpo, Jeonnam, in 2021.


He is also accused of paying a seller and receiving about 3 grams of marijuana at a location in Gwanak-gu, Seoul, in 2017.


The court pointed out, "Due to the secretive nature of drug crimes, where transactions and usage are conducted covertly, detection is difficult and the risk of recidivism is high, causing significant social harm."


It added, "Although the defendant bears heavy responsibility for purchasing and smoking marijuana, the sentencing considered that he admitted to the crime and showed remorse, and that he has no prior convictions of the same kind or any criminal record exceeding fines."
