2-Year Probation Sentence for Teenage Boyfriend

A woman in her 20s who was having sexual intercourse on the rooftop of an apartment died, and the court sentenced her teenage boyfriend to a suspended prison term.

According to multiple domestic media reports on the 16th, Judge Jeong Seung-ho of the 1st Criminal Division at Daegu District Court Seobu Branch sentenced A (19), who was charged with causing the death of his girlfriend due to negligence while engaging in affectionate acts on the apartment rooftop railing, to 10 months in prison with a 2-year suspension.

The incident occurred on November 28, 2021. At the time, A, who was 17 years old, was booked on charges of causing the death of his girlfriend B (20) after tying her hands behind her back with a scarf and engaging in affectionate acts near the railing on the rooftop of a 20-story apartment in Dalseo-gu, Daegu. B lost her balance and fell while standing with her back against the railing.

Police investigation revealed that they had consensually tied the woman’s hands behind her back with a scarf during their encounter. B ultimately died from multiple injuries sustained in the accident.

On the 15th, Judge Jeong Seung-ho, Chief Judge of Criminal Division 1 at Daegu District Court Seobu Branch, sentenced A (19) to 10 months in prison with a 2-year probation for involuntary manslaughter.

At trial, A claimed, "The accident happened unexpectedly," and "I fulfilled the duty of care that could be taken under the circumstances at the time."

However, the court stated, "Considering the close distance between the ventilation shaft where the two were sitting and the rooftop railing, the foreseeability that standing on the ventilation shaft could lead to falling off the rooftop, and the failure to hold B to prevent her from losing balance, negligence is recognized," but also explained the sentencing by saying, "Taking into account that A was a young teenager at the time and there were circumstances to consider regarding the outcome of the incident."
