Prosecution Appeals 'Baby Swap' Not Guilty Verdict for Biological Mother of 3-Year-Old Girl in Gumi The biological mother, Ms. Seok, of the 3-year-old girl who died in Gumi, Gyeongbuk, is leaving the Gimcheon branch of Daegu District Court after being sentenced to 8 years in prison in the first trial on August 17 last year.

[Asia Economy Reporter Kim Daehyun] Seok Mo (50), identified as the biological mother in the case of a 3-year-old girl in Gumi, Gyeongbuk, will face the Supreme Court's judgment again.


On the 7th, the Daegu District Prosecutors' Office announced that it had filed an appeal with the Criminal Appeal Division 1 of the Daegu District Court (Presiding Judge Lee Sanggyun) against the retrial ruling that sentenced Seok to 2 years in prison with a 3-year probation.


The retrial court on the 2nd acquitted her of the charge of abducting a minor, stating that the charge was not proven, and sentenced her to 2 years in prison with a 3-year probation only for the attempted concealment of a corpse.


Earlier, Seok was prosecuted on charges of abducting a minor for allegedly swapping the baby born to her biological daughter Kim Mo (24, currently serving a sentence) at an obstetrics clinic in Gumi between the afternoon of March 31, 2018, and the next morning, and secretly taking her daughter's baby somewhere.


Seok was also charged with attempted concealment of a corpse for placing the body of the deceased 3-year-old girl into a box and attempting to move it from the villa where her daughter lived on February 9, 2021, one day before reporting the girl's death to the police.


Until the time of the incident, Seok pretended to be the deceased girl's maternal grandmother and consistently denied giving birth during the investigation and trial, but was ultimately revealed to be the biological mother, causing shock.


The first and second trials found all charges guilty and sentenced her to 8 years in prison. Seok appealed the verdict to the Supreme Court.


In June last year, the Supreme Court ruled that additional review was necessary regarding the baby swapping crime and ordered the case to be re-examined and judged.
