Interfering with Medical Treatment as a Guardian after Traffic Accident
10 Months Imprisonment with 2 Years Probation and 120 Hours Community Service
[Asia Economy Reporter Kim Hyunjung] A man in his 50s who assaulted nurses attempting to draw blood to check his son's alcohol consumption after a traffic accident was given a suspended sentence.
Judge Lee Jihee of the Changwon District Court Criminal Division 7 announced on the 25th that A (57), who was charged with violating the Emergency Medical Services Act and assault, was sentenced to 10 months in prison with a 2-year suspension and ordered to perform 120 hours of community service.
A's son suffered serious injuries in a vehicle rollover accident and was transported to an emergency treatment center at a hospital in Gimhae, Gyeongnam, on December 7 last year.
At around 1:13 a.m. on the same day, A, who visited the hospital as a guardian, was prosecuted for obstructing emergency medical treatment for 30 minutes by shouting "Don't touch my son" at two nurses.
At the time, when A learned that the police were trying to draw blood to check his son's alcohol consumption, he angrily shouted at the nurses, "XXX, don't do the alcohol blood test," and hurled insults. He also kicked a metal shelf containing the alcohol blood test kit, hitting the nurses' left eyes and foreheads, causing injuries requiring 2 to 3 weeks of medical treatment.
The court stated, "The defendant's guilt for injuring two nurses working in the emergency room is very serious," and pointed out, "The defendant has a history of several punishments for similar violent crimes, including receiving a summary order for obstruction of official duties in 2013 and a suspended prison sentence for the same crime in 2016." Nevertheless, the court explained the sentencing reason by considering "that the degree of injury to the victims was not very severe."
