Motorcycle Runs Red Light and Crashes... "No Insurance Claim Filed, Yet Blaming Others" Video captured from YouTube 'Han Moon-cheol TV'


[Asia Economy Reporter Na Ye-eun] A motorcyclist who ignored the left-turn signal and went straight, colliding with a vehicle, is refusing to admit fault and has not filed an insurance claim, according to a recent report.


On the 28th, the YouTube channel 'Han Moon-cheol TV' released footage of a collision between a vehicle and a motorcycle that occurred around 1 p.m. on the 18th in Dangjin-si, Chungnam Province.


The informant, Mr. A, stated, "After the accident, I reported it to 112 and 119. The motorcyclist fell and suffered a head abrasion, and there was material damage to both the motorcycle and my car," adding, "The motorcyclist continues to claim that he did not violate the traffic signal."


The released video shows Mr. A’s vehicle making a left turn after receiving the signal. Meanwhile, a motorcycle traveling straight in the opposite lane collides with Mr. A’s car.


Mr. A said, "I gave the black box footage to the police and officially reported the accident, but since there were no casualties and the perpetrator is covered by motorcycle liability insurance, the police told us to resolve the accident matters amicably between the two parties," adding, "The perpetrator claims that I violated the signal and that he was injured, so he is not filing an insurance claim."


He continued, "The police also said they cannot mediate the insurance claim. If I handle the repairs through my own insurance, I will have to pay part of the deductible," he lamented.


Mr. A pointed out, "When I call the perpetrator, he gets angry and hangs up. Even though I try to resolve this amicably, he responds with arrogance," and criticized, "Even if you try to live honestly and truthfully, the law and people's character do not make it easy."


He added, "Although the passengers in the vehicle were quite shocked, there were no serious injuries, and I have no intention of requesting a settlement from the perpetrator," but lamented, "I just want my material damages to be resolved without any loss on my part. Is that such a difficult thing?"


Attorney Han Moon-cheol explained, "Considering the motorcycle’s speed, it could have stopped in time. Mr. A was driving slowly and is not at fault," and added, "According to Article 724, Paragraph 2 of the Commercial Act, the victim can directly claim compensation from the insurance company within the limits of the perpetrator’s insurance coverage."


He further advised, "Even if the perpetrator does not file the insurance claim, if you submit a 'Simple Property Damage Accident Investigation Report' at the police station, you can directly claim compensation from the insurance company and receive full damages," adding, "This applies not only to personal injury but also to property damage. Do not process it through your own car insurance; exercise your direct claim rights."
